Going Postal (http://goingpostalpenpals.net/, “we”, “us”, “GP”, “the site”) is a penpal service and social networking website which allows a user to create a profile, connect with others, and partner with penpals. It is dedicated to writing letters and interacting with other letter-writers. It allows for uploading pictures, posting links to other websites, guest blog posts, and penpal pairing. Going Postal isn’t responsible for the content of external websites, the content of letters received by penpals paired through the site, the guest blog posts, and pictures uploaded or text written by other users. Going Postal is only available to people over 13 years of age.

Acceptance of Terms

By joining Going Postal or being a member of Going Postal (having a Going Postal account), you are subject to these Terms of Use, which may be updated periodically without prior notice. Failing to comply with the Terms of Use can result in your account being deleted.

Your Account

By creating an account on Going Postal, you agree that you are responsible for the security of your account as well as the information within your account. Going Postal is currently a private website, but Going Postal does not make any guarantee about the security of the information that you present on the site. Because of this, we do not require you to fill out your profile in its entirety. Any information you provide is solely at your own discretion, and we are not responsible for the security of this information. Please be careful.

Limitation of Liability

In no event will Going Postal, or its suppliers or licensors, be liable with respect to any subject matter of this agreement under any contract, negligence, strict liability or other legal or equitable theory for: (i) any special, incidental or consequential damages; (ii) the cost of procurement or substitute products or services; and (iii) for interruption of use or loss or corruption of data. Going Postal shall have no liability for any failure or delay due to matters beyond their reasonable control. The foregoing shall not apply to the extent prohibited by applicable law.

Indemnification

You agree to indemnify and hold harmless Going Postal, its contractors, and its licensors, and their respective directors, officers, employees and agents from and against any and all claims and expenses, including attorneys’ fees, arising out of your use of the Website, including but not limited to your violation of this Agreement.

Termination

Going Postal can and may terminate your account or any information within, as well as all photos, written text, or profile information, for any reason, including but not limited to lack of use, violation of the letter or spirit of the Terms of Use, posting inflammatory or illegal material, and abuse of Going Postal’s resources (bandwidth, disk space, penpal service, etc). You agree that Going Postal shall not be liable to you or any third-party for any termination of your access to the site. We may delete your account or information at any time or for any reason and you agree we will not be held liable for lost data.

Penpals

A penpal is defined as someone who you exchange letters with, either once or multiple times. Going Postal will not be held responsible for the content of letters given to you from a Penpal, messages sent to you over the site from other users or Penpals, pairing you up with a Penpal at all (even if requested), pairing you up with a Penpal who you do not approve of, or respecting any of your Penpal pairing requirements.

Member Conduct

By joining Going Postal and producing content for the site, you agree that:

* the downloading, copying and use of the Content will not infringe the proprietary rights, including but not limited to the copyright, patent, trademark or trade secret rights, of any third party;
* if your employer has rights to intellectual property you create, you have either (i) received permission from your employer to post or make available the Content, including but not limited to any software, or (ii) secured from your employer a waiver as to all rights in or to the Content;
* you have fully complied with any third-party licenses relating to the Content, and have done all things necessary to successfully pass through to end users any required terms;
* the Content does not contain or install any viruses, worms, malware, Trojan horses or other harmful or destructive content;
* the Content is not spam, is not machine- or randomly-generated, and does not contain unethical or unwanted commercial content designed to drive traffic to third party sites or boost the search engine rankings of third party sites, or to further unlawful acts (such as phishing) or mislead recipients as to the source of the material (such as spoofing);
* the Content is not pornographic, libelous or defamatory (more info on what that means), does not contain threats or incite violence towards individuals or entities, and does not violate the privacy or publicity rights of any third party;
* your profile is not being advertised via unwanted electronic messages such as spam links on newsgroups, email lists, other blogs and web sites, and similar unsolicited promotional methods; and
* your profile is not named in a manner that misleads your readers into thinking that you are another person or company. For example, your blog’s URL or name is not the name of a person other than yourself or company other than your own
